Terms and Conditions

Terms & Conditions of Sale

Effective Date: January 2026

These Terms and Conditions govern the sale of all artwork through this website. By purchasing artwork, the purchaser agrees to be bound by these Terms.

Original Artwork

  • All artwork offered for sale is original and created by a local artist based in New Brunswick, Canada.

  • All artwork is sold subject to availability.

  • All sales are subject to review and acceptance prior to shipment. The artist reserves the right to refuse or cancel any sale at their sole discretion.

  • If a sale is refused or cancelled, payment received will be refunded to the purchaser, less any non-refundable payment processing fees incurred.

Pricing

  • All prices are listed in Canadian Dollars (CAD).

  • All prices are final and non-negotiable. Requests for price negotiation will not be considered or responded to.

  • All prices are non-taxable.

  • Shipping within New Brunswick is included in the listed purchase price.

  • Shipping to addresses outside New Brunswick, but within Canada, is additional and will be invoiced separately.

  • The artist ships within Canada only.

Payment

  • Full payment for the artwork is required at the time of purchase.

  • Where applicable, additional shipping fees must be paid in full prior to shipment.

  • Sales are considered final at the time the financial transaction is completed, whether the artwork is shipped or collected locally.

Shipping

  • All artwork shipped within New Brunswick has fees included in the price

  • All artwork shipped outside New Brunswick has additional shipping fees

  • all artwork is shipped exclusively via Canada Post.

  • Upon purchase, the artwork will be professionally packaged and measured to determine final shipping dimensions.

  • A shipping quote will be obtained using the Canada Post shipping calculator.

  • Shipping will include insurance coverage equal to or greater than the value of the artwork, based on the nearest available coverage option.

  • Artwork will be shipped within fourteen (14) business days of purchase, provided full payment (including any additional shipping fees) has been received.

  • The artist is not responsible for delays caused by the shipping carrier.

  • Risk of loss transfers to the purchaser upon delivery to the shipping carrier.

  • The purchaser is responsible for providing accurate and complete shipping information. The artist is not liable for loss or delay resulting from incorrect information provided by the purchaser.

Damage in Transit

  • All shipments include insurance coverage up to the declared value of the artwork.

  • The purchaser must inspect the artwork upon receipt and report any visible damage to the shipping carrier immediately, and to the artist within 48 hours of delivery.

  • The artist will cooperate with the shipping carrier to file insurance claims for damage during transit.

  • Any claims for damaged artwork are subject to the shipping carrier’s insurance terms. The artist is not responsible for damages that occur after delivery has been accepted by the purchaser.

  • No Funds will be returned until the full investigation/inquiry is complete

Local Pickup

Final Sale Policy

  • All sales are final.

  • No returns, refunds, or exchanges will be accepted under any circumstances.

  • This policy applies whether the artwork is shipped or picked up locally.

Limitation of Liability

  • The artist’s liability is limited to the purchase price of the artwork.

  • The artist is not liable for any indirect, incidental, or consequential damages arising from the sale, shipment, or use of the artwork.

Governing Law

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of New Brunswick, Canada.

  • Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New Brunswick.
